New rules to Safeguard Mobile Consumers

The mobile network operators were unable curb the misleading selling practices, despite launching a voluntary code of practice in July 2004. When the consumer complaints kept pouring in, Ofcom had to wield its authority to formulate new rules. All mobile broadband and mobile service providers can now either conform to the new norms or face a fine of up to ten percent of their relevant turnover.

According to Ofcom, when the new rules were proposed in March last year the number of complaints drastically dropped from 600 to less than 200 a month. Now, with the new rules in effect, the providers are prohibited from all mis-selling practises. The providers have been asked to make sure the consumer is given all information on everything from pay as you go mobile broadband, free laptop deals or contract laptops before a contract is made and to see that the cashback offers are not limited by certain undisclosed conditions. The network operators have also been assigned the responsibility to conduct diligent checks on their retailers and resellers.

It is disappointing to see that the regulatory body had to step-in to prevent these dishonest market practices, which the mobile companies could have tackled themselves. However, this new move by Ofcom certainly safeguards the interest of the consumers and is being seen as a refreshing change. The only question that faces Ofcom is why it took so long to intervene in a matter that deserved its attention much earlier.

Government’s Broadband Levy Strategy under Cloud of Suspicion

BT thinks the UK government is riding too high on its hopes of building a sophisticated digital communications infrastructure across Britain in three years’ time. Despite all its talk about the Next Generation Fund and fibre optic broadband, the government seems to harbour a quixotic notion in planning to finance the broadband UK infrastructure scheme through the proposed 50p per month tax levy.

Expressing her doubts about the ability of the tax scheme to finance such an ambitious undertaking, BT’s group director of strategy and portfolio Olivia Garfield said at a briefing at BT’s London headquarters that a target of 80 to 85 per cent seems more realistic, rather than the 100 per cent fibre optic broadband coverage as claimed by the government. According to her, 50p broadband tax levy is not enough to achieve the target of nationwide hi-speed broadband connectivity.

Garfield added that BT did not play any role in the levy decision. She told the press that news of the proposed levy came as a surprise to BT just before the official Digital Britain report release.

BT is eager to find further details of the Next Generation Fund and the distribution of the fund money, and it expects Ofcom to provide information in this regard. Meanwhile the parliament is going to investigate if Digital Britain recommendations along with the 50p broadband tax concept will indeed succeed in altering the digital communications scenario in Britain as it promises to do.
